Entry Restrictions

Open only to New Zealand residents aged 18 or over, excluding directors, officers, management and employees (and the immediate families of directors, officers, management and employees) of the Promoter, or of the agencies or companies or participating outlet(s) associated with this competition.

Competition Period

The competition in New Zealand runs for a period of six weeks, starting 12:01am (NZST) 16/10/2014, and ending 11:59pm (NZST) 27/11/14

In one transaction, purchase two 750ml bottles of Penfolds wine collection (Eligible Purchase) brands from the following; Penfolds Grange 2010, Bin 707 2012, RWT 2012, St Henri 2011, Reserve Bin A 2013, Bin 389 2012, Bin 150 2012, Bin 407 2012, Bin 28 2012, Bin 9 2012 and Bin 2 2012 from any participating stores during the Promotion Period in New Zealand (Outlet); and

Draw Details

The draw will take place at 5pm (NZST) on 4/12/14 at Dentsu Aegis Network, Level 4, 165 The Strand, Parnell, Auckland, 1010. The first five valid entries drawn will each be awarded one Prize Package.

Prize Details

There are 5 Prize Packages to be won, each comprising:

Winner Notification and Publication

The winners will be notified by phone and in writing immediately after the draw and their name and city of residence will be published on the Websiteon11/12/14 for a period of 28 days.

Prize Claim Date and Time

Prizes must be claimed by 11:59pm (NZDST) on 11/12/14.

Unclaimed Prize Draw Details

9am (NZDST) on 12/12/14 at the same location as the original draw.

Unclaimed Prize Draw Winner Notification and Publication

Any winner(s) in the Unclaimed Prize Draw will be notified by phone and in writing immediately after the Unclaimed Prize Draw and their name and state/territory of residence will be published on the Website on 19/12/14 for a period of 28 days.

  2. The competition will be conducted in each participating Outlet during the Competition Period.
  3. Enter using any text capable NZ mobile phone (021, 022, 027 & 029). Texts to 8824 will incur standard carrier charges..
  4. Each entrant will receive a free return text (SMS) notification confirming their successful entry into the competition. By entering this competition, entrants consent to receiving this electronic message.
  5. Entries must be received during the Competition Period. Entries are deemed to be received at the time they are received by the Promoter’s database and not at the time of submission by the entrant. Failure of an entrant to provide their receipt/s (as per the Retain Receipt requirements) (without alteration) to the Promoter upon request may, at the Promoter’s discretion, result in an invalid entry (and, at the Promoter’s discretion, in all of the entrant’s entries being invalid). The Promoter is not liable for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence due to error, omission, tampering, deletion, theft, communications failure or otherwise. The Promoter has no control over communications networks and is not liable for any problems associated with them due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred. Entrants who enter using multiple mobile numbers or aliases may be disqualified. Consumers are responsible for their own costs associated with the text (SMS) entry.
  6. The draw will be conducted at the time, date and location as stated in the Draw Details.
  7. The prizes are as stated in the Prize Details.
  8. The winners will be notified in accordance with the Winner Notification and Publication details. By entering this competition, each entrant requests that his or her full address not be published.
  9. The winners must, at the Promoter’s request, participate in all promotional activity (such as publicity and photography) surrounding the winning of any prize, free of charge, and they consent to the Promoter using their name and image in promotional material.
  10. The Promoter may require winners to provide proof of identity, proof of age and proof of residency at the nominated prize delivery address. Identification considered suitable for verification is at the Promoter’s discretion.
  11. If a winning entry is deemed not to comply with these conditions of entry, the entry will be discarded and a new winner of that prize will be determined by drawing a further valid entry in accordance with paragraph 6.
  12. The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this competition by, any person who tampers with or benefits from any tampering with the entry process or with the operation of the competition or acts in violation of these conditions, acts in a disruptive manner or acts with the intent or effect of annoying, abusing, threatening or harassing any other person.
  13. The Promoter’s decision is final and no correspondence will be entered into.
  14. Prizes are not transferable or exchangeable. If a prize is unavailable for any reason, the Promoter may substitute for that prize another item of equal or higher value as determined by the Promoter.
  15. If a prize has not been accepted or claimed in accordance with the Prize Claim Date and Time, the relevant winner’s entry will be deemed invalid and the Promoter will conduct such further draws in accordance with the Unclaimed Prize Draw Details as are necessary to distribute the prize/s. Any winner(s) in this draw will be notified as stated in the Unclaimed Prize Draw Winner Notification and Publication details.
  16. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this competition or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
  17. Without limiting the previous paragraph, the Promoter and its associated agencies and companies will not be liable for any damage, loss or delay in transit to prizes.
  18. If for any reason any aspect of this competition is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the competition.
  19. The Promoter is not liable for any tax implications arising from prize winnings. Independent financial advice should be sought.
  20. The Promoter encourages consumers to enjoy alcohol responsibly.   21. All entries will be the property of the Promoter. The information entrants provide will be used by the Promoter for the purpose of conducting this competition. The Promoter may collect entrants’ personal information (including through its contractors or agents) or disclose entrants’ personal information to its contractors and agents to assist in conducting this competition or communicating with entrants. By entering this competition, entrants consent to the storage of their personal information on the Promoter’s database and the Promoter may use this information for future competition and marketing purposes regarding its products, including contacting the entrant via electronic messaging. By entering this competition, entrants consent to receiving SMS or email messages from the Promoter that do not contain any functional unsubscribe facility. The Promoter is bound by the Privacy Principles in the Privacy Act 1993 (NZ).  Entrants can request access to the personal information the Promoter holds about them by contacting the Promoter at the address stated in the Promoter section of these conditions.
