Re-corking Clinics Terms & Conditions

1. Eligibility Criteria

The purpose of a PENFOLDS Re-corking Clinic ("Clinic") is to service PENFOLDS red table wines that meet the eligibility criteria. Despite anything else in these terms and conditions, PENFOLDS reserves the right to refuse to open any bottle of wine, or to limit the number of bottles of wine that may be submitted for assessment at the Clinic, in its absolute discretion and regardless of whether it a bottle meets the eligibility criteria.


To be eligible for the Clinic, a wine must be: a) a PENFOLDS red table wine; b) at least 15 years old; and c) must not be an Ineligible Wine.


If a wine meets the following criteria under (a) or (b) below, it will not be eligible for assessment at the Clinic ("Ineligible Wine"). a) Automatic Ineligibility A wine will not be eligible for assessment at the Clinic if it: i. is without a label; ii. has a label that is illegible; iii. has been assessed at a previous Clinic; or iiii. is missing an original capsule. b) Discretionary Ineligibility A wine may not be eligible for assessment at the Clinic, as determined by PENFOLDS in its absolute discretion, if: i. the level of wine has dropped below the shoulder; ii. the bottle has experienced water submersion; or iii. the capsule has evidently been tampered with.


We note that: a) bottles in good condition will not normally be opened; and b) under no circumstances will PENFOLDS re-label any wine that is presented at the Clinic 2. Assessment: Wines From 1950 Vintage (1950-2003 vintages inclusive) a) Both the PENFOLDS winemaker and the owner of the wine must decide whether or not to open the wine. b) Once agreed, PENFOLDS shall taste and assess the wine. c) If in PENFOLDS absolute discretion the wine is in an acceptable condition and the wine is found to be a good example of the wine style and vintage, the wine will be: i. topped up with a recent vintage of the same wine; ii. re-corked with a Clinic cork; iii. re-capsuled at the Clinic; and iv. labelled with a Clinic Certification label, signed by a PENFOLDS winemaker. d) In these circumstances the Clinic Certification label will certify that the wine has been opened, tasted and re-corked by PENFOLDS at the Clinic. e) Wines opened, tasted and the wine determined by PENFOLDS to be in unacceptable condition, meaning that the wine will not benefit from further cellaring or is no longer a good example of the wine style and vintage (“Unacceptable Condition”), will be re-corked with a plain, unbranded cork. Under no circumstances will these wines be topped up, re-capsuled or have the Clinic Certification label affixed. 3. General a) You are responsible for your wine at all times. PENFOLDS will take the utmost care in handling your wine, however, we accept no responsibility for any loss or damage to the wine or any other loss or damage that you may incur. b) PENFOLDS does not provide any warranty that the services provided at the Clinic will improve the condition of the wine, add value to the wine or prevent the deterioration of the wine in the ordinary course.


You grant to us the right to film, photograph and make audio and/or visual recordings of you at the Clinic (together “Recordings”). You confirm that there are no restrictions that prevent you from participating in the Recordings. You agree that we will own all the Recordings and have the right to use, edit, alter and exploit them by any means in any media throughout the world. You assign to us any rights, title and interest (including copyright) that you have in the Recordings and release us from any claims and liability arising from any such use and exploitation of the Recordings.
